Effective November 1, 2011, Macomb County Circuit Court has implemented a Specialized Business Docket pilot program pursuant to Local Administrative Order 2011-05.

For any case that meets the mandatory Category I criteria as outlined in the LAO, you must file a Notice and Order for Assignment to the SBD. If a case meets the eligible Category II criteria, you may file a Stipulation and Order for Assignment to the SBD.


All SBD cases will be assigned to Judge John C. Foster’s docket and will become mandatory eFiling cases.

Mandatory Cases - Category I

  • Business governance/internal affairs, including shareholder derivative and oppression suits
  • Business Torts
  • Antitrust Law

  • Business-to-business disputes (including contracts, construction disputes and employment matters)
  • Environmental law (with business plaintiff or defendant)

  • Indemnification Claims
  • Malpractice claims brought by business (non-medical)

  • Products liability
  • Personal injury and wrongful death
  • Medical malpractice
  • Commercial landlord versus consumer tenant
  • Noncommercial real estate matters
  • Actions by consumers against businesses and businesses against consumers
  • Commercial class actions, proceedings to enforce a judgment
  • Occupational health and safety matters
  • Matters subject to compulsory arbitration if involving Category III subject
