In re: Weather Emergencies

Pursuant to Michigan Supreme Court Administrative Order 1998-5 and State Court Administrative Office Administrative Guideline 1999-02, the following procedure is adopted by the 16th Judicial Circuit when contemplating closing the Court due to inclement weather:

1. This order covers the Macomb County Circuit Court facility in downtown Mt. Clemens and the Juvenile Division located on North Rose.

2. The Chief Judge, or person designated by the Chief Judge, will consult with the Chairman of the Macomb County Board of Commissioners and/or the Macomb County personnel designated by the Chairman to be responsible for declaring a weather emergency, to determine if there is a weather emergency sufficient to close the Court.

3. If the funding unit declares a weather emergency and closes the facilities where the Court is located, Court employees will charge time off in a manner consistent with the Macomb County employee handbook, any applicable collective bargaining agreement or any action taken by the funding unit in the specific emergency.

4. If the court closes and releases its employees, but Macomb County does not agree to close the facilities, then the Court employees must use accumulated annual leave time, accumulated personal business leave or unpaid leave, unless there is a collective bargaining agreement to the contrary.

5. A closure determination will be announced to the Court employees and all appropriate law enforcement agencies by a means to reasonably assure notice. Public notice will be made by posting a notice on the public entrances to the facility and delivering public service announcements over local radio or television stations.

6. This order is effective April 1, 1999.
